Hold onto your Constitution, folks — Stephen Miller just hinted that the Trump team is seriously thinking about hitting pause on habeas corpus. Yep, that habeas corpus — the one that stops the government from locking you up without a court hearing. No big deal, right?

Speaking to PBS NewsHour, Miller — Trump’s longtime policy pit bull — casually dropped the bombshell that the former (and possibly future) president is “actively looking at” suspending the centuries-old legal safeguard.

Why? Because of Venezuelan gang members allegedly sneaking across the border. Miller called it an “invasion,” which he claims gives them the constitutional green light to yank habeas corpus right off the shelf.

Let’s rewind: The U.S. Constitution does allow suspension of habeas corpus, but only in cases of “rebellion or invasion.” Lincoln did it during the Civil War. Bush talked about it post-9/11. Now Trump’s crew is flirting with it because of border security. Seriously.

Miller’s reasoning? According to Axios, he sees gangs like Tren de Aragua — a nasty Venezuelan outfit — as proof the country is under attack. Not metaphorically. Literally. So, his logic goes, it’s time to fast-track deportations without all that due process stuff slowing things down.

But legal experts? Not exactly on board. As The Guardian pointed out, courts have already rejected Trump’s “invasion” talk in past cases. This isn’t their first attempt to sidestep the courts with creative readings of the Constitution.

Still, Team Trump seems undeterred. It’s all part of a bigger immigration crackdown they’re teasing — one that could put civil liberties in the backseat.

Whether this is a serious legal move or just red-meat rhetoric, it’s already sending shockwaves. Because suspending habeas corpus isn’t just a policy flex. It’s the kind of thing that makes law professors spit out their coffee.

And yes — we’re talking about the same guy (Miller) who once tried to rewrite asylum rules with a Sharpie and once reportedly floated flying migrants to Guantanamo.
